Website and registered User Portal. Software products and paid professional engagements may be subject to separate agreements
Navigation
1. Who provides this website
2. Scope and relationship with other agreements
These Terms of Use («Terms») govern access to geomythic.com, its public pages, contact and assessment forms, meeting-booking links and the GeoMyth User Portal, including registration and account management.
These Terms do not themselves grant a licence to install or use GeoMyth desktop software. If software is released, its use may be subject to a separate End User Licence Agreement (EULA) presented before download, installation or activation. Client consulting, confidential file exchange, paid training, certification, corporate support programmes and commissioned development are subject to separate terms or written agreements where offered.
A separately agreed contract, statement of work, non-disclosure agreement or data processing agreement governs its specific subject matter if it conflicts with these general website Terms. Nothing in these Terms overrides mandatory legal rights or mandatory data-protection requirements.
3. Acceptance and eligibility
You may browse public pages without creating an account. When you register for a User Portal account and actively confirm acceptance of these Terms, you enter into an agreement with GeoMyth for the account and associated online functionality. If you do not accept these Terms, do not register or use the User Portal.
You must have the legal capacity to accept these Terms, or obtain the legally required permission of a parent, guardian or authorised representative. The website is intended primarily for professional and business users and is not directed to children.
If you use the User Portal on behalf of an organisation, you must be authorised to provide its information and act for it where you represent that you have such authority. Creating an individual account does not by itself establish a contract for professional services on behalf of that organisation.
4. User accounts and profile information
To access the User Portal, you must register using accurate information and a valid email address, complete the required email-verification step and keep your account information reasonably up to date. Some profile fields, such as first name or last name, may be optional.
Accounts are intended for individual use. You must not impersonate another person, create accounts through automated abuse, transfer an account to another person or allow others to use your credentials without our written authorisation.
The User Portal currently provides account registration, login, profile editing, password recovery, logout and account deletion. The availability of further functions shown as planned or «Coming soon» is not a commitment to launch them on a particular date.
5. Account credentials and security
You are responsible for taking reasonable care of your username, password and access to your email account, and for promptly telling us if you suspect unauthorised access or an account-security problem. Contact us at contact@geomythic.com.
We may use email verification, anti-bot checks, security controls and service messages to protect accounts and operate the portal. Transactional messages relating to registration, confirmation, password reset and security are distinct from marketing communications. Opening an account does not subscribe you to a newsletter.
We cannot guarantee that an internet-based service will be free from every security risk. Our handling of personal information is described separately in our Privacy Policy.
6. Acceptable use
You may use the website and User Portal for lawful personal, educational or professional purposes consistent with their intended functionality. In particular, you must not:
- seek access to another user’s account, protected pages, data, systems or non-public functionality without authorisation;
- bypass or interfere with authentication, access controls, rate limits or security checks, or test system vulnerabilities without prior written authorisation;
- introduce malicious code, overload the service, disrupt its operation or misuse automated requests or scraping in ways that infringe rights or unreasonably burden the infrastructure;
- submit unlawful, fraudulent, misleading, defamatory, infringing or malicious material, or material you have no right to provide;
- misuse the website to send spam, harvest personal data, misrepresent an affiliation with GeoMyth or violate applicable law.
Ordinary lawful use of public website content, including reasonable browser access and standard search-engine indexing, is not prohibited solely because it is automated.
.
7. Availability, restrictions and suspension
We may maintain, update, change or temporarily suspend parts of the website or portal for security, maintenance, technical problems or legitimate operational reasons. We do not promise uninterrupted availability or a particular uptime level unless this has been expressly agreed in writing.
We may restrict or suspend an account where reasonably necessary to investigate suspected compromise, prevent abuse, comply with law or address a material breach of these Terms. Where practicable and appropriate, we will provide information about the reason and an opportunity to resolve the issue. We will not exercise these rights in a manner that unlawfully restricts mandatory consumer or contractual rights.
8. Account deletion and its consequences
You may use the Delete Account function in My Profile to delete your website account. Deletion removes the account and associated profile information from the active website database and ends access to account-only features.
Certain security records, transactional emails, third-party service records or backup copies may remain for limited periods where justified and permitted by law, as further described in our Privacy Policy. Account deletion does not automatically cancel a separately signed service agreement, erase records that must lawfully be retained, or settle existing contractual obligations.
Any consequences of account deletion for future software licences will be specified in the applicable software licence terms when such licensing functionality is introduced.
9. Website content and online assessments
Content on this website, including articles, graphics, descriptions of services and online assessment tools, is provided for general information and initial business discussions. Automated test scores or categories are preliminary, based on the answers supplied and do not constitute a formal technical audit, certified report, resource or reserve estimate, investment recommendation, or professional opinion on a specific project.
Geological, geostatistical, engineering and mineral-resource decisions require suitably qualified professional review, adequate input data, verification and consideration of relevant reporting codes and standards. You must not rely solely on website content or test results for operational, regulatory, safety-critical, financial or investment decisions.
The scope, standard of care, deliverables and permitted reliance for any professional GeoMyth engagement are defined by the applicable written service agreement or statement of work.
10. Enquiries, meetings and professional services
Contact forms, meeting-booking facilities, descriptions of services and invitations to discuss a project are not binding offers to provide a specific consulting service at a particular price or deadline. Submitting an enquiry or booking a meeting does not itself create a paid consulting engagement.
Any project scope, fees, schedule, deliverables, intellectual-property arrangements, confidentiality terms or professional reliance conditions will be agreed separately in writing before the relevant services commence.
11. Information submitted by users
You are responsible for ensuring that information you submit through public forms, assessments or messages is accurate to the best of your knowledge, lawful and provided with the necessary rights or permissions. Please do not put confidential geological databases, commercially sensitive project material, privileged documents or unnecessary personal data into public forms or appointment descriptions.
You and your organisation retain ownership of materials and information that belong to you. Submitting an enquiry or test response does not transfer ownership of your geological data, models, documents or intellectual property to GeoMyth. We may handle submitted information only as needed for the relevant interaction and as described in our Privacy Policy or an applicable agreement.
12. Confidential project files and restricted exchange
Where GeoMyth agrees to a client file-exchange arrangement, access is individually authorised only after prior communication and an agreed non-disclosure agreement (NDA); any service agreement or other written access instructions may also apply. This is not an open public upload service.
The rights, confidentiality obligations, access permissions, permitted processing, storage, return and deletion of client project files are governed primarily by the applicable written agreement. You must not upload third-party material unless you have the right to do so.
13. Software, downloads and planned licensing
GeoMyth is developing proprietary geological software, including the planned GeoForming product. References to software, licence activation, downloads or other future functions on the website do not mean those functions are presently available or constitute an offer of a software licence.
Our stated product direction is free-of-charge proprietary software, but the detailed licence grant, permitted professional and commercial use, distribution, machine activation, updates, support, termination and any usage restrictions will be established in the EULA applicable to the released product. These website Terms do not impose paid tiers or grant rights to software source code.
Unless and until a product and its licence terms are actually made available, no desktop-software licence arises solely from website registration.
14. Intellectual property and website materials
Except for content belonging to users or third parties, intellectual-property rights in the GeoMyth name, logos, website design, original texts, illustrations and other website materials belong to GeoMyth or its licensors.
You may access, read and make reasonable internal reference copies of publicly provided materials for lawful personal or professional evaluation, with ownership notices preserved. You may not falsely present materials as your own, use GeoMyth marks to imply sponsorship or endorsement, or commercially republish or redistribute substantial website content without permission or another legal basis.
Nothing in these Terms transfers ownership of user-supplied geological information to GeoMyth, and nothing grants a licence to any desktop software or source code.
15. Feedback and suggestions
We welcome ordinary comments, corrections and suggestions about the website or our potential products. Please do not send confidential designs, proprietary code, undisclosed technical information or another party’s protected material unless we have first agreed in writing how it will be handled.
Non-confidential feedback may be considered when improving the website and planning future products, without a promise of payment, implementation, attribution or acceptance. This does not transfer ownership of separate files, client datasets or protected works, and specific commissioned development is governed by a separate agreement.
16. Third-party services and external links
Certain features may connect to external services, such as a meeting-booking provider, email delivery services or restricted cloud storage. Third-party services may have their own terms and privacy information. We do not control third-party websites and do not endorse every statement or service accessible from an external link.
Use of an external provider is subject to applicable law and the conditions of that provider. This clause does not remove responsibilities GeoMyth may have for service providers acting on our behalf.
17. Personal data and Privacy Policy
How we collect, use, retain and protect personal data, including account and authentication information, is described in the GeoMyth Privacy Policy available at https://geomythic.com/privacy-policy/.
Acceptance of these Terms is not, by itself, consent to receive marketing messages. Any optional newsletter or marketing consent is handled separately, and you may exercise data-protection rights through the contact information in the Privacy Policy.
18. Information accuracy, warranties and availability
We make reasonable efforts to keep website information current, but public information may be incomplete, outdated or contain errors. Features may change as the website develops. To the extent permitted by applicable law, the website and its free online functionality are supplied on an «as available» basis without an express guarantee that every page, test or service will always be available, free of errors or suitable for a particular professional task.
This section does not limit any express obligation in a signed agreement or any warranty, conformity or remedy that cannot lawfully be excluded.
ks of unauthorised access, loss, alteration or disclosure of data.
19. Responsibility and limitation of liability
Users remain responsible for decisions based on their own project information, test answers and independent interpretation of general website materials. GeoMyth is not responsible for losses caused by reliance on preliminary online test results as though they were a commissioned professional report.
To the extent permitted by applicable law, GeoMyth is not liable for indirect or consequential losses arising solely from ordinary use of the public website or free User Portal, including loss of expected business opportunities, where such exclusion is legally valid. We do not exclude or limit liability for fraud, wilful misconduct, gross negligence, or any injury, damage, statutory consumer right or other obligation to the extent such exclusion or limitation is prohibited by applicable law.
Any limitation of liability applicable to paid professional services or licensed software must be set out in the separate agreement governing those services or that software.
20. Changes to these Terms
We may update these Terms to reflect changes in law, security, services or the website. The current version and its effective date will be available on the website. Material changes affecting registered users will be communicated by a reasonable method, such as an account notice or email, where appropriate.
Where the law requires fresh agreement to material changes, we will request it before applying those changes to the relevant contractual relationship. If you do not accept changed Terms, you may stop using the User Portal and delete your account, subject to applicable law and any separate agreement.
